Judge Rules HHS Broke Law in Rush to Erase ‘Gender Ideology’ References

On July 3, U.S. District Judge John D. Bates determined that the Trump administration’s Office of Personnel Management breached federal law when it instructed the Department of Health and Human Services (HHS) to swiftly comply with a broad executive order targeting “gender ideology.” In response, HHS agencies removed or edited thousands of federal health websites, cutting content on HIV prevention, contraception, STIs, mental health, and more — especially resources related to transgender and non-binary people.

Not About Ideology, It’s About Lawful Process

Judge Bates emphasized that the case wasn’t about the government’s views on gender, but about procedural overreach. He faulted the administration for using a 48-hour deadline to compel agencies to delete vital information without a plan to revise or restore it. The court found that this violated the Administrative Procedure Act—a bedrock law intended to ensure that government decisions are made with transparency, reasoned analysis, and public input.

The ruling doesn’t force the Trump administration to change its ideology, but it does require the restoration of key public health resources that doctors and patients rely upon.
