Meta is reportedly moving to automate up to 90% of its product risk assessments using AI, per internal documents viewed by NPR. These assessments are part of Meta’s obligations under a 2012 agreement with the Federal Trade Commission (FTC), which requires it to evaluate the privacy and safety risks of product changes. Under the new system, Meta’s internal teams would complete a questionnaire about proposed updates, after which an AI model would instantly flag risks and set compliance requirements before launch. This shift could significantly reduce time-to-market, but also raises concerns about whether AI can adequately anticipate nuanced or emerging privacy risks.

AI-Based Compliance May Be Efficient—But Comes with Legal and Reputational Risks

Startups considering similar automation strategies should tread carefully. While automating compliance reviews might improve efficiency and scale, regulators will still expect meaningful oversight, especially when existing consent decrees or privacy laws like the GDPR or CCPA apply. Over-relying on AI could result in missed red flags, particularly in cases involving edge cases, sensitive populations, or platform-wide behavioural changes. If your product processes user data or has social, safety, or content moderation implications, your internal risk assessments could come under the microscope in the event of a breach or public backlash. Meta has spent over $8B perfecting its privacy automations; most startups would struggle to dedicate any significant funds to the endeavour.

Balancing Speed and Accountability in Product Development

The takeaway for startups is this: while automation can support compliance at scale, it does not absolve founders or executives of legal accountability. Companies must still ensure that internal processes are robust, auditable, and include human review where necessary, especially for novel, high-risk, or high-impact features.
