California Establishes First AI Companion Chatbot Safety Law
California Governor Gavin Newsom has signed SB 243, a landmark law regulating AI companion chatbots. The legislation, effective January 1, 2026, requires companies operating chatbots — from major AI labs like OpenAI and Meta to specialized platforms like Character AI and Replika — to implement safety protocols aimed at protecting children and vulnerable users. Key provisions include age verification, warnings for minors, break reminders, restrictions on sexually explicit content, suicide and self-harm prevention protocols, and clear disclosure that interactions are AI-generated. SB 243 also imposes penalties of up to $250,000 for illegal deepfake activity. The law was prompted by tragic incidents involving minors and exposes AI platforms to direct legal accountability for harm caused through unregulated chatbot interactions.
